Press Release: WR Immigration Files Lawsuit to Stop Wastage of EB-5 Investor Visas

On Friday, August 5th, 2022, WR Immigration and Banias Law filed a complaint in the U.S. District Court for the District of Columbia on behalf of hundreds of Chinese foreign national plaintiffs requesting the court to compel the U.S. Department of State to authorize fiscal year (FY) 2022 EB-5 immigrant visa numbers be allocated to all plaintiffs and their families by September 30, 2022, and to process their immigrant visa applications promptly.    This lawsuit seeks to compel the State Department to follow the plain language of its own regulations and “allocate” the visas prior to the end of FY 2022. If the registration is selected in this lottery, the employer may proceed with the H-1B petition process to file with USCIS. Do individuals need to do anything? No, they do not need to do anything at this time. If the registration is selected in this lottery, the employer may proceed with the H-1B petition process to file with USCIS. Why is USCIS conducting a second lottery? USCIS did not receive sufficient H-1B cap petitions during the initial 90-day filing period (April 1 to June 30) to meet the quota for both the “Bachelor’s” cap and the “Master’s” cap for FY2024. What’s next? USCIS will conduct the lottery shortly. Employers and their representatives will receive USCIS […]
