State Dept. Imposes New Restrictions on Chinese Communist Party Members

As part of a continued chilling of relations between the United States and China under the Trump administration, on December 4, 2020, the Department of State announced several new restrictions on Chinese Communist Party members, including:

  • New rules limiting the validity of B1/B2 visas to one month and single-entry for Chinese Communist Party members and their families. B1/B2 visas for Chinese nationals are normally valid for 10 years and allow multiple entries.
  • Termination of five exchange programs, including the Policymakers Educational China Trip Program, the U.S.-China Friendship Program, the U.S.-China Leadership Exchange Program, the U.S.-China Transpacific Exchange Program, and the Hong Kong Educational and Cultural Program.

A Department of State spokesperson told the New York Times that no current visas would be revoked as a result of the policy changes.

EB-5 Regional Center Program Reauthorized Through September 30, 2027

With President Biden’s signature, the EB-5 Regional Center Program – which has been lapsed since July 1, 2021 – has been reauthorized through September 30, 2027, under the “EB-5 Reform and Integrity Act of 2022.”   WR Immigration is pleased to see that Congress has kept its side of the bargain for existing investors who have been stuck in limbo for the past 8 months. Also with grandfathering now in the law, lapses like this will be avoided in the future. While the legislation is far from perfect, it provides a workable framework for EB-5 to continue bringing in foreign direct investment to create jobs for qualifying U.S. workers for the foreseeable future.  Several updates and “integrity measures” will now become part of EB-5 law, and USCIS will need to engage in administrative rulemaking to fill in some of the blanks and provide additional clarity to EB-5 stakeholders.   Most importantly, the legislation includes “grandfathering” language that would allow USCIS to continue processing petitions for immigrant investors filed on or before September 30, 2026, if Congress does not further reauthorize the Regional Center program in the future.  Changes include: Increased investment to $1,050,000, or $800,000 for investments in rural areas […]

EB-5 Visa Availability for the May 2022 Visa Bulletin and Reservations on Reserved Visas-Skipping the Waiting Line is Un-American

DIRECT EB-5 CURRENT FOR ALL COUNTRIES, INCLUDING CHINA All countries are current under the 5th preference direct program – so-called “Unreserved (C5, T5, and all others) are now open. This includes China. B. REGIONAL CENTER EB-5 CURRENT FOR ALL COUNTRIES, EXCEPT CHINA STUCK AT 22NOV15 C. NEW SET ASIDE CATEGORIES CURRENT FOR ALL COUNTRIES, INCLUDING CHINA As of March 2021, 32% of all EB-5 visas are reserved as follows: 20% reserved for qualified immigrants who invest in a rural area; 10% reserved for qualified immigrants who invest in a high unemployment area; and 2% reserved for qualified immigrants who invest in infrastructure projects. Any unused “set aside” visas are to be reserved for a maximum of two years.  The remaining 68% are unreserved and are allotted for all other qualified EB-5 immigrants.
