H-1B Cap Season Arrives

H-1B cap season is here, and it’s time to think about who might be eligible for an H-1B visa. The H-1B cap registration will take place at the end of March, and USCIS will conduct its lottery in early April. Once the lottery has taken place, the winners must file their H-1B petitions within 90 days.  

 For first-time H-1B petitions, registration for the H-1B cap is needed in March. Foreign nationals applying for an H-1B for the first time holding the following visa statuses should register: 

  • F-1 Optional Practical Training (OPT) 
  • F-1 STEM OPT 
  • TN (Canadian or Mexican) if more stable status is desired 
  • L-1 if there is a PERM application and an extension beyond 5 or 7 years is needed 

 Before filing an H-1B registration, we recommend scheduling an assessment of your case to determine its viability and to evaluate any issues that might result in USCIS responding with a Request for Evidence.

USCIS Updates Policy Guidance on CSPA ‘Sought to Acquire’ Requirement U.S. Citizenship and Immigration Services (USCIS) announced on August 24, 2023, that it is updating the USCIS Policy Manual to clarify how it will apply the extraordinary circumstances exception to the “sought to acquire” requirement under the Child Status Protection Act (CSPA) in light of a February 14, 2023, policy change updating when an immigrant visa becomes available for the purpose of calculating an applicant’s CSPA age. USCIS explained that the CSPA protects certain beneficiaries from losing their eligibility for immigrant visas and adjustment of status because they age during the immigration process and no longer qualify as a child for immigration purposes. To benefit from the CSPA, noncitizens must seek to acquire lawful permanent resident status within 1 year of when an immigrant visa becomes available, USCIS noted. In this edition, find the latest news on DHS’ announcement on DACA policy, the latest guidance for diversity visa selectees, USCIS’ updated guidance for religious workers, and more.   DHS Announces Final Rule to ‘Preserve and Fortify’ DACA Policy The Department of Homeland Security (DHS) announced a final rule to “preserve and fortify” the Deferred Action for Childhood Arrivals (DACA) policy for certain eligible noncitizens who arrived in the United States as children. DACA allows beneficiaries an opportunity to receive a renewable, two-year work permit. DHS said that DACA has allowed more than 800,000 young people, dubbed “Dreamers,” to remain in the United States. The rule, effective October 31, 2022, was published in the Federal Register on August 30, 2022. It continues the DACA policy announced in a 2012 memorandum from Janet Napolitano, then-Secretary of Homeland Security, that DACA recipients should not be a priority for removal. DHS received more than 16,000 comments during the public comment period. The final review codifies existing DACA policy, with limited changes, and replaces the DACA policy guidance set forth in the 2012 Napolitano memorandum.
