EB-5 Regional Center Immigration Compliance: Mandatory Filing of Form I-956G by December 29, 2025

Overview of Form I-956G Requirement

As the end of the 2025 federal fiscal year (September 30, 2025) approaches, all EB-5 Regional Centers designated before that date are required to file Form I-956G, Regional Center Annual Statement, for fiscal year 2025. This filing is due no later than December 29, 2025, as mandated by U.S. Citizenship and Immigration Services (USCIS).  Filing Form I-956G is essential for maintaining regional center designation under the EB-5 Reform and Integrity Act of 2022 (RIA). Failure to file timely and complete reports may result in termination of regional center designation, regulatory penalties, and/or loss of investor confidence.

Key Components of I-956G

The Regional Center must submit general information about its operations and include an “Attachment 1” for each sponsored “new commercial enterprise” (NCE) associated with a filed Form I-956F and/or with “active EB-5 investors” during fiscal year 2025, which includes investors who have received conditional permanent residence but have not yet filed Form I-829.  Regional Centers should consider the Form I-956G as an annual check up to prepare their Form I-829 templates.  Each Attachment 1 should include evidence demonstrating:

  • The total EB-5 capital investment in the NCE, backed by accounting records, bank statements, and/or wire transfers.  
  • That 100% of EB-5 investor funds have been committed to the EB-5 project, such as ledgers, draw schedules, or bank transaction records (see Fund Administrator)
  • Construction status, such as new permits, construction photos, recent draw requests, or investor updates
  • Job creation, ideally an updated economic impact report based on expenditures through September 30, 2025
  • Fee Disclosures – A complete listing of all fees collected from EB-5 investors for solicitation or locating services through September 30, 2025
