Termination of TPS for Nicaragua, Honduras and Nepal

As of February 11th, USCIS has updated its website for Temporary Protected Status (TPS) for Nepal, Honduras and Nicaragua, terminating the TPS Programs for these countries and ending the automatic extension of work authorization.

How did we get here?  On February 9, 2026, a three-judge panel from the Ninth Circuit Court of Appeals in National TPS Alliance, et. al v. Noem et. al, [No. 3:25-cv-05687-TLT], granted the Department of Homeland Security’s request to stay an order issued by a district court on  December 31, 2025.  That district court had ordered the continuance of Temporary Protected Status (TPS) for 60,000 people from Honduras, Nepal and Nicaragua.  This order resulted in the termination of TPS for these countries to be postponed for at least such time as there would be a hearing on the merits of the case.

The order from the Ninth Circuit Court stated that “the district court’s order vacating the termination of TPS for Nepal, Honduras, and Nicaragua is stayed pending appeal.”  This means that the U.S Department of Homeland Security is now permitted to proceed with the termination of the TPS Program for Nepal, Honduras and Nicaragua while the case still winds its way through courts for a hearing on the merits.

Employers are now required to reverify the work authorization of such individuals whose work authorization is based on TPS.  The individuals now need to present alternative valid authorization to work in order to continue employment.
