In April 2025, our EB-5 investor client concurrently filed their Form I-526E (Regional Center Investor Petition) and Form I-485 (Adjustment of Status). Like many EB-5 investors, they faced uncertainty about how long their case might take and were worried about the inevitable retrogression.
Then on September 5, 2025, the client’s I-526E petition was approved but the I-485 adjustment application remained pending.
Taking Action with a Writ of Mandamus
Recognizing that further delay could result in being stuck in a long waiting line, Client retained WR Immigration on September 22, 2025, to file a Writ of Mandamus (a federal court action that compels USCIS to act on unreasonably delayed cases). Our litigation team moved quickly, filing the case in three days. Just over two weeks later, on October 14, 2025, USCIS approved the conditional green cards.
