Applicants Must Apply for Nonimmigrant and Immigrant Visas in Country of Nationality or Residence
The U.S. Department of State (DOS) has issued new guidance, effective September 6, 2025, clarifying where nonimmigrant visa (NIV) applicants must apply for their U.S. visa interviews. This follows DOS’s similar announcement last week regarding Immigrant Visa interview location.
- NIV and IV applicant visa interviews will be in their country of nationality or residence.
- If applying in a country based on residency (rather than nationality), applicants must provide evidence of residence in that country.
- For nationals of countries where the U.S. does not maintain routine Immigrant Visa or Nonimmigrant Visa operations, applications must be made at designated U.S. embassies or consulates.
- According to the State Department, existing nonimmigrant visa appointments will generally not be canceled under this new guidance, however, we have received reports of applicants being turned-away on their appointment date.
- There are limited exceptions for diplomats and for humanitarian reasons.
- Applicants should plan ahead and consult legal counsel or their immigration representative when considering interview locations.
- Individuals residing outside their home country should ensure they have valid proof of residence if applying in their country of residence.
