Impact of U.S. Supreme Court Decision
On June 25, the U.S. Supreme Court issued a decision that impacted the TPS designation and protections for Haiti and Syria. While the Supreme Court’s decision cleared the path for Department of Homeland Security to proceed with termination of TPS designations for Haiti and Syria, it alone did not immediately end the TPS designations and the related employment authorization for those two countries. Therefore, the TPS designations and employment authorization remain in place until: (1) the Supreme Court sends a certified copy of its judgment to the lower court; and (2) the federal administration issues implementation guidance.
When Do TPS Designations and Work Authorization for Haiti and Syria Expire?
Employers may continue to rely on the existing TPS EAD cards for Haiti and Syria until such time that action is taken by the lower courts to terminate TPS employment authorization. As we previously noted, employees may have alternative forms of work authorization that remain valid. Thus, before determining that an employee is no longer eligible to work, employers will need to communicate with the employee to determine whether or not they have another valid List A or List C document that permits them to continue to work.
U.S. Citizenship and Immigration Services (USCIS) had previously provided July 1, 2026 as a “placeholder” expiration date for purposes of completing the Form I-9 for TPS designations for Haiti and Syria. On July 1, USCIS announced that the “placeholder” expiration date for employment authorization for TPS Haiti and Syria is now July 10, 2026. This is not an official termination of employment date. This is a placeholder for employers as the final actions wind through the courts for Miot et al. v. Trump et al., No. 25-cv-02471-ACR (D.D.C.) (Haiti) and Dahlia Doe v. Noem, 25-cv-8686 (S.D.N.Y.) (Syria).
Takeaway for Employers
Employers should take the following action steps:
- Identify any employees whose current work authorization depends on TPS Haiti or Syria
- Confirm the Reverification Step by 7/1/2026
- When having the relevant employees complete Supplement B, ensure the company is allowing them to choose any acceptable documentation from the List of Acceptable Documents
- Set up a ticker system for July 10, 2026 based USCIS “placeholder” extension
