October 2025 Visa Bulletin – USCIS to Use Dates for Filing

The Department of State has released the October 2025 Visa Bulletin, opening FY 2026 with several notable developments for employment-based categories.

Key Highlights

  • EB-1, EB-2, and EB-3: Modest advancement across several countries (up to 3.5 months), with both China and India moving forward slightly.
  • EB-5 India: Largest gain this month, with the Final Action Date advancing nearly 15 months.
  • Dates for Filing: Significant movement in EB-1 through EB-3, with some categories advancing more than one year.
  • EB-5 China (Dates for Filing): Retrogression of three months.

USCIS has confirmed it will apply the Dates for Filing chart for employment-based adjustment of status filings in October 2025. This means individuals with priority dates earlier than the cutoffs in the Dates for Filing chart may be eligible to file Form I-485.

Action Items for Employers

  • Review Eligibility Carefully: Assess employee cases against the updated Dates for Filing chart to identify who may now qualify for adjustment of status. Early review ensures no opportunities are missed during the October window.
  • Prepare Filings Proactively: Confirm that PERM approvals, I-140 petitions, and supporting documentation are complete so adjustment applications can be filed without delay. Timely preparation is critical given the high demand for visa numbers.
