USCIS will accept employment-based adjustment of applications from foreign nationals with a priority date that is either current “c,” or earlier than the Final Action Dates listed in Chart A of the August Visa Bulletin. USCIS has announced that F2A applicants may file using the Final Action Dates chart. Applicants in all other family-sponsored preference categories must use the Dates for Filing chart.
Preference Category Trends
EB-1 remains current for all countries except China and India. China and India will advance six and nine months respectively to February 8, 2018.
EB-2 remains current for all countries except China and India. China will advance by two months to January 15, 2016. India will remain at July 8, 2009.
EB-3 (for professional and skilled workers) will advance by almost a full year to April 1, 2019, except for China & India. Cutoff dates for China will advance by eight months to February 15, 2017, and India will advance four months to October 1, 2009.
EB-5 remains current for all countries, except China and Vietnam. China and Vietnam will advance modestly by two weeks and months, respectively.
